Two students who hacked MTN computers granted N100m bail
A Federal High Court in Lagos on Monday granted N50m bail each to two students of Moshood Abiola Polytechnic and Resign Regal Academy, Timothy Oluwabukola and Anthony Odemerho, who allegedly hacked MTN Nigeria Communication computers and stole airtime and data valued at N1.9bn.
Justice Akintayo Aluko granted them bail after hearing two separate bail applications filed by the defendants.
In addition to the bail sum, Aluko ordered the defendants to provide two sureties each, one of whom must be a civil servant in the federal or Lagos State employment, who must be grade level 14 and above.
He said that the second surety must be a landed property owner within the jurisdiction of the court, provide evidence of ownership, and must swear to an affidavit of means.
In the case of the civil servant, they must produce a reference letter of their place of work, and a letter of last promotion, while the defendants must submit two recent passport photographs to the court registrar.
Aluko ordered that the prosecution should verify all documents submitted by the sureties including their residential addresses.
The court further ordered that the defendants be remanded in the Correctional Centre pending the fulfilment of their bail conditions.
Oluwabukola and Odemerho were arraigned on July 30, 2024, by the Police Special Fraud Unit.
They are facing four counts bordering on conspiracy, unauthorised access into the company’s web-based platform known as Application Programming Interface and unlawful conversion, preferred against them by the police.
The police prosecution counsel, Justine Enang, told the court that the defendants committed the alleged offences with others now at large.
Enang told the court that Oluwabukola and Odemerho, said to be students of Moshood Abiola Polytechnic Abeokuta, Ogun State, and Resign Regal Academy in Benin City, Edo State, respectively, committed the offences sometime between January and April 2024, in Lagos and Edo states.
He said that the duo allegedly hacked into the MTN web-based platform known as Application Programming Interface, and stole N1.9bn worth of airtime and data.
According to the prosecutor, the offences committed contravened Sections 27(1)(b); 6(2) and 28(1)(b) of the Cybercrime (Prohibition, Prevention, etc) Act, 2015 as amended in 2024, but punishable under Section 8(2) of the same Act.
He added that the offences also contravened Section 18(2)(b) of the Money Laundering (Prevention And Prohibition) Act, 2022, punishable under Section 18(3) of the same Act.
However, the defendants pleaded not guilty to the charges against them.
Following their not-guilty plea, the prosecutor asked the court for a trial date and urged the court to remand them in the custody of a correctional centre till the determination of the charge.
But, the defence lawyer informed the court that he had filed two applications for bail and the same had been served on the prosecutor.
In response, the prosecutor confirmed being served with the bail applications but told the court that he was served while the proceedings were going on.
He asked the court for a short date to enable him to study the applications and respond to them.
Consequently, Justice Aluko adjourned the case till August 5, 2024, for a hearing of the defendants’ bail applications.

Change of name, age declaration… federal high court begins online affidavit process
The federal high court (FHC) has commenced electronic affidavit (e-affidavit) for the benefit of litigants and other users.
In June, John Tsoho, FHC chief judge, introduced the e-affidavits into the court’s practice directions in line with global best practices.
During a facility inspection on Friday, Godwin Longe, deputy chief registrar of the Lagos federal high court, said the new technology can only process affidavits that are non-cases related.
“Affidavits filed to support a case are still done manually because of the peculiar disposition in such affidavits,” Longe said.
He emphasised that with the online system, people do not “necessarily have to be physically present to procure the type of affidavits mentioned above”.
Agwu Charles, head of the court’s ICT department, explained how the public can use the innovation.
“It is now a norm that the affidavit for loss of items, age declaration, change of name, etc can now be done via portal.fhc.gov.ng and following the instructors,” he said.
“What you just need to do is to log in to the site: portal.fhc.gov.ng.”

‘We were on routine investigation’ — DSS debunks invading SERAP office
The Department of State Services (DSS) says its operatives did not unlawfully invade the Socio-Economic Rights and Accountability Project (SERAP) office in Abuja.
On Monday, SERAP said the DSS agents were “unlawfully occupying” its office in Abuja, adding that they had demanded to see its directors.
The group had asked President Bola Tinubu to direct the DSS to end the harassment, intimidation, and attack on the rights of Nigerians.
In a statement on Tuesday, the DSS said its operatives were lawfully detailed on routine investigation to the SERAP office in Abuja.
The secret police said they have been inundated with multiple enquiries on what transpired.
“This narrative is inaccurate and misleading in its intent,” the statement reads.
“For the records, a team of two (2) unarmed Service operatives were lawfully detailed on routine investigation to SERAP office in Abuja, which has sadly been skewed and misinterpreted as unlawful, harassment and intimidation of SERAP officials.
“The Service further wishes to state that such official enquiries and liaison are traditional and does not in any way amount to illegality or raid.
“While it assures of in-depth investigation of these malicious contents, it sues for citizens’ participation in national security management.”
The DSS asked the public to disregard “false narratives”, restating its commitment to professionalism in discharging its core mandate with utmost dedication and integrity.

‘Police acted on petition after it was withdrawn’ — Air Peace speaks on Ajaero’s arrest
Air Peace, Nigeria’s flag carrier, has corroborated TheCable’s report that Joe Ajaero, president of the Nigeria Labour Congress (NLC), was arrested over a petition by the airline in 2023.
On Monday, Ajaero was arrested by security operatives suspected to be personnel of the Department of State Services (DSS).
Following his arrest, sources told TheCable that the arrest was due to his failure to honour police invitation over a petition by Air Peace.
Also, Ajaero was said to have failed to honour an invitation by the DSS over an alleged case of extortion.
In a statement on Monday by Omotade Makinwa, Air Peace spokesperson, the airline said the police acted on the petition a year after it was withdrawn.
“Air Peace Airline expresses deep concern over recent media reports regarding the arrest of the President of the NLC in connection to a petition filed by the airline in September 2023,” the company said.
“This development, which has led to negative publicity, does not reflect the current relationship between Air Peace and the NLC.
“It is important to clarify the events leading up to the petition. On May 3, 2023, the NLC disrupted Air Peace operations as part of a broader conflict with the Imo State government.
“Although Air Peace had no involvement in the dispute between the NLC and the Imo State government, our airline was unfortunately used as a tool to exert pressure on the government.
“This unlawful disruption of our services caused significant financial losses and impacted the travel plans of many Nigerians across multiple states.
“In response to this disruption, Air Peace’s legal team submitted a formal petition against the NLC to the Nigerian Police. Despite our repeated efforts to follow up on the petition, the Police failed to take prompt action.”
However, Makinwa said, over a year later, the police have chosen to act on the original petition, “which has now led to the alleged arrest of the NLC president”.
“Before this arrest, the airline and the NLC had already reached an amicable resolution, and Air Peace had withdrawn its petition, allowing a positive working relationship to resume between the two organisations,” he added.
On August 19, the police invited Ajaero for questioning over “a case of criminal conspiracy, terrorism financing, treasonable felony, subversion, and cybercrime”.
